1. Acceptance of Terms

Welcome to Island Tycoon. These Terms of Service ("Terms") govern your access to and use of Island Tycoon and related services (the "Service"), operated by Breaking Barriers Now B.V. ("we", "us", or "our"). By creating an account, signing in, or using the Service, you confirm that you are at least 13 years old (or the minimum age required by applicable law in your jurisdiction) and agree to comply with these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of the Service

Island Tycoon is a casual online game that combines gacha capsule mechanics with strategic island building, real-time PVP (attack and steal), fishing, boat racing, and card collection. The Service is available as a browser-based web application and as a mobile app. Your game progress is stored on our servers and synchronized across platforms when you sign in with the same account.

3. Account Registration and Google Sign-In

To access the Service, you need to create an account. Island Tycoon supports Google Sign-In as an authentication method. When you sign in with Google, we access your basic Google profile information (name, email address, profile picture) solely to create and manage your Island Tycoon account. Our use of Google user data is described in detail in our Privacy Policy.

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Game Rules and Fair Play

When using Island Tycoon, you agree not to:

• Use cheats, exploits, automation software, bots, or any unauthorized third-party tools
• Exploit bugs or glitches in the game for unfair advantage
• Engage in any activity that disrupts or interferes with other players' enjoyment
• Create multiple accounts to gain unfair advantages
• Buy, sell, or trade accounts or in-game items outside of official channels
• Harass, threaten, or abuse other players
• Use offensive or inappropriate usernames or profile content

5. Virtual Currency and Items

Island Tycoon may include virtual currency (coins) and virtual items. You acknowledge that:

• Virtual currency and items have no real-world monetary value
• Purchases of virtual currency are final and non-refundable except as required by applicable law
• We reserve the right to manage, regulate, modify, or remove virtual items at our discretion
• You do not own virtual items; you have a limited, non-transferable license to use them within the game

6. Intellectual Property

All content in Island Tycoon, including but not limited to graphics, artwork, text, music, sound effects, game mechanics, and software, is owned by us or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

7. User Content

If you submit content (such as usernames, messages, or feedback), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with operating and improving the Service. You represent that you own or have the right to submit such content and that it does not violate any third party's rights.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, storage, and sharing of your personal information, including Google user data obtained through Google Sign-In, is governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements, as described in our Privacy Policy.

9. Account Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.

10. Account and Data Deletion

You may request deletion of your account and associated personal data at any time by contacting us at islandtycoongame@gmail.com. If account deletion functionality is available within the game, you may also use that feature directly. Upon account deletion, your game progress, virtual items, and associated data will be permanently removed, subject to any data we are required or permitted to retain under applicable law. 11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for fraud or personal injury caused by negligence).

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.
